This Privacy Policy explains what information Folio Insights LLC (“Folio,” “we,” “us”) collects when you use the Folio website and API (the “Service”), how we use it, and the choices you have. Folio is operated from the United States. We designed the Service to collect as little personal information as possible, and we do not use advertising or third-party analytics trackers and do not sell your personal information.

The Service provides access to public records published by government sources (for example, USPTO trademark and assignment records, TTAB proceedings, and state corporate-registry filings). Those records may include information about individuals — such as the names and addresses of trademark owners, attorneys of record, registered agents, and company officers — that was made publicly available by the originating government authority. This Privacy Policy covers the account and usage information described in Section 1; it does not cover publicly available government-record data, which we process as published by its source and which is generally exempt from consumer privacy laws such as the CCPA. If a public record about you is inaccurate, contact the originating authority, which controls the official record; corrections it publishes flow through to the Service when we next refresh that dataset.

3. How we use information

We use the information above to: authenticate you and provide the API; verify your email; enforce rate limits and prevent fraud and abuse; bill and manage subscriptions; secure, monitor, and debug the Service; send transactional and service messages (such as verification codes and account notices); and comply with legal obligations. We send transactional email only; any future marketing email would include an unsubscribe link, per the CAN-SPAM Act.

4. Legal bases (EEA/UK users)

The Service is operated from the United States and is directed to users in the United States. Where the EU or UK GDPR nonetheless applies, we process personal data to perform our contract with you (providing the Service) and based on our legitimate interests in securing the Service, preventing abuse, and operating our business, and to comply with legal obligations.

We share personal information only with the service providers (sub-processors) that process it on our behalf to run Folio. They are contractually bound to use it only to provide their services to us:

6. We do not sell or share your personal information

We do not sell your personal information, and we do not “share” it for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act (CCPA), as amended by the CPRA. We have not sold or shared personal information in the preceding 12 months.

We retain personal information only as long as needed for the purposes described here:

When information is no longer needed, we delete or anonymize it. Residual copies may persist in routine encrypted backups for a limited additional period before being cycled out, and we may retain information longer where reasonably necessary to comply with legal obligations, resolve disputes, prevent abuse, or enforce our agreements.

8. Security

We use reasonable technical and organizational measures designed to protect your information, including encryption in transit, access controls, and limiting who can access data. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security. If a breach affecting your personal information occurs, we will notify you and the relevant authorities as required by law.

9. International data transfers

Folio is operated from the United States, and our service providers process data in the United States. If you access Folio from outside the United States, including the European Economic Area or the United Kingdom, you understand that your information will be transferred to, stored, and processed in the United States. Where required, transfers of EEA/UK personal data rely on the European Commission’s Standard Contractual Clauses (and the UK Addendum) implemented by our service providers.

You may request access to, correction of, or deletion of your personal information by emailing support@folioapi.com. We may need to verify your identity (for example, via your account email address) before acting on a request, and we will respond within the time required by applicable law. We will not discriminate against you for exercising your privacy rights. Depending on where you live, you may have rights under the CCPA/CPRA (California) or the GDPR/UK GDPR — including the rights of access, rectification, erasure, restriction, portability, and objection — and you may lodge a complaint with your local data-protection authority. Requests concerning public-record data in the Service are handled as described in Section 2.

11. Children’s privacy

Folio is a developer tool intended for businesses and is not directed to children. We do not knowingly collect personal information from children under 13 (or under 16 in the EEA/UK). If you believe a child has provided us personal information, contact us and we will delete it.

12. Cookies & tracking signals

Our website uses only strictly necessary cookies — for example, a session cookie that keeps you signed in. We do not use advertising, tracking, or third-party analytics cookies. The Folio API itself does not set cookies. Because we do not track users over time and across third-party websites, we do not respond to “Do Not Track” browser signals, and — because we do not sell or share personal information — Global Privacy Control signals do not change how we process it.

13. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above, and we will provide notice of material changes. Your continued use of the Service after an update means you accept the revised policy.
